1. Agreement to Terms

By accessing or using Interview Prompter ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Interview Prompter is a desktop application that provides real-time audio transcription and AI-assisted response suggestions during interviews and meetings. The Service requires a macOS or Windows computer with microphone and screen recording permissions.

3. User Accounts

To use the Service, you must create an account with a valid email address. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any laws or regulations
  • Record conversations without proper consent where required by law
  • Infringe on others' intellectual property rights
  • Transmit malware or harmful code
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any illegal or unethical purposes
  • Misrepresent AI-generated content as your own original thoughts in contexts where disclosure is required

5. Recording Consent

Important: Many jurisdictions require consent from all parties before recording conversations. You are solely responsible for:

  • Understanding and complying with recording consent laws in your jurisdiction
  • Obtaining necessary consent before using the Service
  • Any legal consequences of recording without proper consent

We recommend consulting with a legal professional if you are unsure about recording consent requirements in your area.

6. Subscription and Payments

6.1 Pricing

The Service is offered on a subscription basis. Current pricing is available on our website. We reserve the right to change pricing with 30 days notice.

6.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. All payments are processed by Stripe and are non-refundable except as required by law.

6.3 Cancellation

You may cancel your subscription at any time. Your access will continue until the end of the current billing period.

7. Intellectual Property

The Service, including all software, design, and content, is owned by Interview Prompter and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service for its intended purpose.

Content generated during your sessions (transcriptions, AI responses) is yours to use, subject to any third-party rights in the underlying content.

8. AI-Generated Content

The AI responses provided by the Service are generated by artificial intelligence and should be used as suggestions only. You acknowledge that:

  • AI responses may contain errors or inaccuracies
  • You are responsible for reviewing and verifying any AI-generated content
  • AI suggestions should not replace professional advice (legal, medical, financial, etc.)

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTERVIEW PROMPTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Indemnification

You agree to indemnify and hold harmless Interview Prompter from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.
